Sue Schauls called the meeting to order at 9:15 a.m.

NMVTIS/Affidavit Rule Writing – Sue reported there is still no written

rules draft available at this time although the law went into effect on

January 1, 2016. Jim Piazza, IAR Lobbyist, has asked the board to put

together a list of points we would want added to the law once there is

an opportunity and that the window to do this would close rapidly at

this point. Although Sue felt there is no point in amending a law that

has no written rules yet. She said the one item to add may be the lien

check which we are doing voluntarily already. The main purpose of

updating the rule would be to put the NMVTIS reporting back to 30

days for non-affidavit cars or repeal the law until the intent can be bet-

ter expressed such as an Iowa NMVTIS system for reporting. The law

was not created to target enforcement on licensed auto recyclers but

to give DOT tools

to identify and

ticket illegal oper-

ators.

Pat Rooff briefed

the Board on

some DOT action.

The DOT has

been advising tow

yards to get a re-

cycler’s license

due to the code

for Rule 321H.3

which states that

a recycler’s li-

cense is required

if there are 6 or

more vehicles

subject to regis-

tration onsite. It

was questioned

whether or not

these tow yards

require recyclers

licenses in lieu of

enforcement ac-

tion. Perhaps they

do not even meet
